Terms of use
Draft awaiting legal review: SITE_LEGAL_NAME, SITE_LEGAL_ADDRESS, SITE_CONTACT_EMAIL.
By using the MARZI apps (the ordering app, the MARZI Market app, the manager app) and the MARZI web pages, you agree to the terms below.
1. The parties and the service
MARZI is operated by [not set yet] ([not set yet]). MARZI is software that helps shops receive orders on phones. The sales contract is between you and the shop you buy from; MARZI does not sell the shop's goods and is not the one who delivers them. In MARZI Market only, we receive your order and your payment and then pass each shop's part to that shop.
2. Accounts
- You give correct information, keep your password secret and are responsible for what happens under your account. Tell us at once if you think it has been exposed.
- You are at least 16, or a parent or guardian agrees.
- You can delete your account at any time (see Delete account).
- For a shop with its own website, the account is managed by that website and follows that shop's terms.
3. Ordering and paying
- Prices, stock, delivery fees and delivery times are decided by the shop. A shop may refuse or cancel an order when goods run out, a price is wrong or delivery is impossible, and will tell you.
- You may pay on delivery or by bank transfer through a QR code. With a QR code the money goes straight to the shop's bank account; check the account holder's name before you transfer and keep the transfer description unchanged. In MARZI Market the money goes to MARZI's account and we settle with the shops.
- Exchanges, returns and refunds follow the shop's policy and consumer-protection law. You can send a cancellation or refund request in the app; the shop decides and carries it out.
4. Rules of use
You must not: use the apps for anything unlawful; create fake orders or commit payment fraud; attack, probe or overload the system; collect data in bulk; remove or reverse-engineer the software beyond what the law allows; infringe other people's rights.
5. For shops, agencies and staff
- A shop is responsible for its products, prices, content, pictures and delivery; the pictures and content it uploads must be ones it has the right to use.
- A shop decides how its own customers' data is used and must obey personal-data law when it receives data through MARZI.
- Management accounts are only for people the shop allows; keep passwords secret and have an account switched off as soon as a staff member leaves.
- The commercial terms between MARZI, an agency and a shop (plans, fees) follow a separate agreement.
6. Intellectual property
The MARZI software, brand and interface belong to us or our licensors. The content a shop publishes (names, pictures, product descriptions) belongs to the shop; the shop allows MARZI to show it in the apps in order to provide the service.
7. Availability and limit of liability
We try to keep the service running reliably but do not promise that it is uninterrupted or error-free; we may do maintenance or change features. As far as the law allows, we are not liable for indirect loss, lost profit or faults of third parties (shops, banks, carriers, network operators). This does not exclude liability that the law does not allow to be excluded.
8. Suspension and ending
We may suspend or end an account that breaks these terms or puts the system or other people at risk. You can stop using the service and delete your account at any time.
9. Personal data
How we handle personal data is described in the Privacy policy.
10. Changes, governing law
We may update these terms and will change the "Last updated" date; if you keep using the service after an update you accept the new version. These terms are governed by the law of Vietnam. Disputes are first settled by negotiation; if that fails, they go to the competent court in Vietnam.
